Electronic Signature Legality in the UAE
Are Electronic Signatures Legal in the UAE?
Yes. Electronic signatures are legally recognized and enforceable in the United Arab Emirates under Federal Law No. 46 of 2021 on Electronic Transactions and Trust Services (ETTS Law). This law provides a strong legal framework for businesses and individuals to adopt digital and electronic signatures with confidence.
What the UAE Law Says
The ETTS Law classifies electronic signatures into different categories based on their level of trust and security. These include:
Standard Electronic Signatures (SES): Basic forms like scanned images, typed names, or checkbox confirmations.
Advanced and Qualified Electronic Signatures (QES): These use digital certificates and encryption, offering higher security and legal standing.
For high-value transactions or legal documents, the UAE government recommends using qualified or certified digital signatures to ensure authenticity, integrity, and non-repudiation.
When Are E-Signatures Valid?
- Business contracts
- HR documents and internal approvals
- Vendor and supplier agreements
- Real estate transactions (in some Emirates)
- NDAs and consent forms
- Certain government paperwork
