By using the Signature Solutions provided by Truecopy Credentials Pvt Ltd (TRUECOPY), You (the user) agree to the Terms of Service as follows:

1) You agree to use the Service only for the purpose it is intended, which is to digitally sign documents and not misuse it in any way, interfere with it in anyway, or access it in any way other than via standard browsers.

2) Using our Solutions does not give you ownership of any intellectual property rights in them.

3) In connection with your use of the Solutions, we may send you service announcements, administrative messages, and other information, and you agree to act on those as required. If you have to validate / authenticate yourself with an OTP, the OTP shall be sent to mobile number as specified by the document initiator.

4) You agree not to upload or enter any data that is inaccurate, false or misleading or which in any way violates the law of the land. TRUECOPY is not responsible for the data which you upload or enter. TRUECOPY does not validate the contents of the documents or their correctness. TRUECOPY is not a party to the documents, but only a third party signature platform.

5) Privacy
Your document or data that is signed will not be read by Truecopy. It will not be shared with any other third-party by us. For the purpose of maintaining audit information, we capture the IP address, the Browser/OS information and the timestamp during the initiation and signing process. Further, if the initiator desires and the Signer agrees, Video and Geo location is also captured.

6) Availability
This Solutions are being made available via cloud-based servers located in a leading commercial data-centers according the geo-localization requirements. We try to ensure high availability of the service. It is possible however that the service may not be available for small periods of time due to server inaccessibility / downtime for maintenence.

7) Warranties and Disclaimers
We provide our Solutions using a commercially reasonable level of skill and care. These Solutions are provided “AS IS”. NEITHER TRUECOPY NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC WARRANTIES OR PROMISES ABOUT THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.

8) Liability for our Solutions
TRUECOPY WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOSS OR DAMAGES OF ANY OTHER KIND RESULTING FROM THE USE OF OUR SOLUTIONS. THE TOTAL LIABILITY OF TRUECOPY, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID TRUECOPY TO USE THE SOLUTIONS.

9) INDEMNITY
YOU AGREE TO INDEMNIFY TRUECOPY AGAINST ANY CLAIMS RESULTING FROM THE USE OF THE SOLUTIONS.

10) It is your responsibility to ensure that Digital Signatures are valid for the type of documents you intend to sign in any particular country.
